These terms apply when you use lmvctec.in, use one of our apps (Kreyon, Yaam or Pixelle), or engage Lumivance Technologies Private Limited ("Lumivance", "we", "us") for design and development services. By using the website, an app or our services, you agree to these terms. If you do not agree, please do not use them.
Lumivance Technologies Private Limited is a company registered in India, with its office at 2/264, Opp. Petrol Bunk, Palkalai Nagar, Kalvinagar, Rajambadi, Madurai 625021, Tamil Nadu, India. Contact: contact@lmvctec.in.
You may browse this website for lawful purposes. Please do not try to disrupt it, gain unauthorised access to it, or copy its content for commercial use without permission. The website's text, design, logos and images belong to Lumivance or its licensors.
When you download or buy one of our apps, we grant you a personal, non-exclusive, non-transferable licence to use it on devices you own or control, under these terms and the terms of the store you got it from (Google Play or the Apple App Store). The apps are licensed, not sold.
Paid apps and in-app unlocks are sold through Google Play or the App Store, whose payment, trial and refund rules apply to that purchase. Kreyon for Mac and Windows, and Kreyon brush and palette packs, may also be sold on kreyon.digital under the terms published there. Prices are shown in the store before you buy.
Artwork and other content you create with our apps belong to you. We do not claim any rights in it, and because our apps store it on your device, we do not receive it.
Please do not reverse-engineer, resell or redistribute our apps, remove copyright notices, bypass a purchase or licence check, or use the apps to break the law.
Yaam is made for children and should be set up and purchased by a parent or guardian. Our other apps are for general audiences; anyone under 18 should have a parent's or guardian's permission to make purchases.
We improve our apps over time and may add, change or remove features. We will try to keep features you paid for working, but an app may not support every device or operating-system version.
These terms apply to website, app, branding, digital marketing and other technology services we provide. A signed proposal, quotation or agreement for your project takes priority over this section where they differ.
You agree to give us accurate information, respond to questions and approvals in reasonable time, and pay as agreed. We may pause or stop work if payments are overdue or these terms are broken.
Payments are due as set out in your proposal or invoice. We may ask for an advance before starting work. Digital marketing services may be billed monthly. Final files, source code and credentials are handed over once all dues are cleared. Amounts are exclusive of GST unless stated.
Timelines depend on the scope and on how quickly we receive your content and approvals. The number of revisions is set in your proposal; extra revisions or changes in scope may be charged separately.
You are responsible for the content, images, brand assets and other materials you give us, and for having the right to use them. Third-party assets (fonts, images, plugins, software) may need their own licences.
Work we create for you remains ours until it is paid for in full. On full payment, ownership of the final deliverables passes to you unless your agreement says otherwise. We keep ownership of our pre-existing tools, code libraries and know-how, and grant you a licence to use them as part of the deliverables. We may show completed work in our portfolio unless you ask us not to in writing.
For SEO, advertising and social media work, results and rankings cannot be guaranteed: they depend on search and platform algorithms, competition and market conditions. Advertising budgets paid to platforms such as Google or Meta are paid to those platforms and cannot be recovered by us.
Projects may rely on hosting providers, app stores, payment gateways and other third-party services. We are not responsible for their downtime, policy changes, price changes or failures.
Each of us will keep the other's confidential business information, project details and credentials confidential, and use them only for the project.
Either of us may end an engagement as set out in the agreement. We may also end it if payment is overdue, if these terms are seriously broken, or if we receive no response for more than 30 days. You pay for work done up to the end date. Refunds are covered by our Refund Policy.
Our website and apps are provided "as is". We work hard to keep them accurate, secure and available, but we cannot promise they will always be error-free or uninterrupted. Nothing in these terms limits rights you have under consumer protection law that cannot be limited by contract.
To the extent the law allows, we are not liable for indirect or consequential loss, such as loss of profit, business or data. Our total liability for any claim about a paid app or service is limited to the amount you paid us for it in the twelve months before the claim. This does not limit liability that cannot be limited by law, such as liability for fraud.
If you give us content or materials, you agree to cover us against claims that they infringe someone else's rights, and against losses caused by your misuse of our services.
How we handle personal data is explained in our Privacy Policy and the privacy page of each app.
These terms are governed by the laws of India. Subject to any rights you have to approach a consumer commission, the courts at Madurai, Tamil Nadu have jurisdiction. Please contact us first — most problems can be solved quickly by email.
We may update these terms. The new version will be posted here with a new date and applies from then on. If a change materially affects a paid service you are using, we will tell you.
